Terms of use

These terms are an agreement between you and Callum Sutherland ("we", "us"), who run hosty.co.nz. By creating an account you agree to them. Please also read our privacy statement.
The service
hosty.co.nz gives New Zealand businesses a free website at their own hosty.co.nz address and a community to share offers. It's free, and we may add, change or remove features over time.
Your account
- You must be at least 18, or have permission to act for the business you're signing up.
- Give us a real email address and keep your password to yourself. You're responsible for what happens under your account.
- One account per business. Pick a web address that fits your business. Don't claim names to hold them or resell them.
Your content
You own what you put on hosty.co.nz. You give us permission to store it, display it on your site and in the community, and make backups, for as long as it's on hosty.co.nz. You're responsible for making sure what you publish is accurate and legal, and that you have the right to use any names, words, photos, logos or details you add.
Testimonials must be real feedback from real customers, shown with their permission and not edited to change their meaning. Don't write your own, pay for them, or only show feedback in a misleading way. Fake reviews are a breach of the Fair Trading Act.
Messages sent through your site's form are for your business. Only use the contact details in them to reply to that customer, and don't add them to a mailing list without their permission.
What's not allowed
Don't use hosty.co.nz to:
- scam, mislead or defraud anyone, including fake businesses, fake testimonials or misleading prices
- upload photos you don't have the right to use, or photos of people who haven't agreed to it
- pretend to be another person or business, or collect passwords, bank details or card numbers
- sell or promote anything illegal in New Zealand
- publish hateful, harassing, threatening or sexually explicit content
- send spam, or post the same offer over and over
- break the law, including the Fair Trading Act and the Unsolicited Electronic Messages Act
- interfere with hosty.co.nz, other people's sites, or try to get into accounts that aren't yours
Reports, suspensions and removal
Anyone can report a site or post. If we believe something breaks these terms or the law, we can remove it, suspend the site, or close the account, with or without notice. If we suspend your site and you think we got it wrong, email hello@hosty.co.nz.
You can stop using hosty.co.nz at any time, and ask us to close your account by emailing us.
No guarantees
We work to keep hosty.co.nz running and your site online, but because it's free we can't promise it will always be available, error-free or fast, or that your content will never be lost. Keep your own copy of anything important.
hosty.co.nz is provided for business purposes. To the extent the law allows, the Consumer Guarantees Act 1993 doesn't apply, and we're not liable for any loss of business, profit, data or other indirect loss from using hosty.co.nz. Nothing in these terms limits rights you have that can't be excluded by law.
Changes
We may update these terms. If we make a significant change, we'll email account holders before it takes effect. Continuing to use hosty.co.nz after that means you accept the new terms.
Law
These terms are governed by New Zealand law, and New Zealand courts have jurisdiction.
